Private prosecution of Thandi Modise

For the benefit of our supporters, the National Council of SPCA’s (NSPCA) would like to provide clarity. Advocate Gerrie Nel of AfriForum approached the NSPCA and offered his assistance and expertise in seeking justice for the animals that endured immeasurable suffering on a farm in the North West Province.

The National Prosecution Authority decided not to prosecute Thandi Modise for a case of cruelty and neglect in what has been described as one of the cruellest cases of animal cruelty that the NSPCA has ever seen.

A legal team offered to us by AfriForum, especially of this calibre, is not only incredibly costly but also invaluable to the investigation; tracing of witnesses, verifying statements etc., particularly after the case has been in the hands of the state for two years. This is a cost which cannot be borne by the NSPCA, we are simply under resourced and the NSPCA is grateful for this generous support.

Our mission is the prevention of cruelty to animals and the situation in South Africa currently appears to be dire. Cruelty to animals seems to have exacerbated and the workload has increased beyond our resources. We need all our resources to concentrate on animal welfare and be able to undertake the work that our country so desperately needs – without this specific support, we could not have pursued this private prosecution on our own.
